Privacy Policy
This Privacy Policy (this “Policy”) describes the practices of Clair (“Clair,” “we,” “us,” or “our”) concerning the collection, use, disclosure, and protection of information in connection with the Clair mobile application (the “App”) and the website located at getclairapp.com (the “Site,” and together with the App and all related features and services, the “Service”). Clair is a voice- and text-capture and artificial-intelligence reflection tool. We do not sell your personal information.
By creating an account or otherwise accessing or using the Service, you acknowledge that you have read and understood this Policy and agree to the practices it describes. If you do not agree to this Policy, you must not access or use the Service.
1. The Service Provider; How to Contact Us
The Service is provided by Clair. For any question, concern, or request relating to this Policy or to the personal information we process, please contact us at support@getclairapp.com.
2. Information We Collect
We collect only such information as is reasonably necessary to provide, operate, secure, and improve the Service. We collect the following categories of information:
(a) Information you provide to us directly.
- Account Information. When you create an account, we collect your name and email address. If you elect to authenticate through Apple or Google, we receive a unique identifier and the email address (or provider-relayed email address) that such provider makes available to us. We do not receive your Apple or Google password.
- User Content (“Entries”). The voice recordings, transcripts, typed notes, photographs, titles, tags, and other content that you create within the App. We use and disclose your Entries only as described in this Policy.
- Profile and Preferences. Optional details that you elect to provide, such as an avatar, areas of life, reflection preferences, and artificial-intelligence personalization instructions.
- Communications. Information you provide when you contact support or otherwise correspond with us.
(b) Information collected automatically.
- Usage and Diagnostic Data. We and our analytics and diagnostics providers automatically collect information regarding your interactions with the Service, including feature usage and in-App events, device type, operating-system version, application version, language, time zone, crash reports, and performance data. Certain of this information, in particular product-analytics events concerning your use of features, onboarding, and subscriptions, may be associated with your account identifier or email address. We use this information to operate, secure, analyze, and improve the Service.
- Purchase Data. When you purchase a subscription, we and our payment and subscription-management providers receive transaction and subscription-status information (for example, that a subscription is active, together with the applicable plan, renewal status, and a transaction identifier). Apple processes your payment, and we do not receive your full payment-card details.
(c) Information we receive from third parties.
- Authentication providers (Apple, Google) and our subscription, analytics, and diagnostics providers, as further described in Section 6, may provide us with limited information consistent with their respective terms and your settings.
3. Information We Do Not Collect
For the avoidance of doubt, we do not:
- sell, rent, or trade your personal information;
- use your Entries to serve you advertising, nor permit any third party to use your Entries for cross-context behavioral advertising;
- collect precise background location, your contacts, your photo library (other than the photographs you elect to attach), your health records, or device advertising identifiers (IDFA) for tracking purposes; or
- create a biometric “voiceprint” or “faceprint” for the purpose of identifying you. Audio that you record is used to provide transcription and related features. Any Face ID or Touch ID application lock is performed by your device’s operating system, and we do not receive your biometric data.
4. How We Use Information
We use the information described above to:
- provide, maintain, secure, and operate the Service and your account;
- transcribe your voice Entries and generate AI reflections, insights, and related output in connection with your use of the Service’s AI-enabled features (see Section 5);
- process your subscription, any free trial, and renewals;
- respond to your support requests and other communications;
- detect, investigate, prevent, and address fraud, abuse, security incidents, and technical issues;
- analyze usage in order to understand, maintain, and improve the Service;
- create aggregated or de-identified information that does not identify you, which we may use to analyze and improve the Service and which we will not attempt to reidentify; and
- comply with applicable law and enforce our Terms of Service and other agreements.
5. Artificial-Intelligence Processing of Your Entries
The reflection features of the Service operate by transmitting the relevant content of your Entries to specialized third-party artificial-intelligence providers that process such content on our behalf in order to provide the following features:
- Transcription. Your voice recordings are transmitted to a third-party AI provider to convert speech to text.
- Insights and Reflections. Your transcripts and text Entries are transmitted to one or more third-party AI providers to generate summaries, themes, reflections, titles, and other AI output.
- Read-Aloud. Where you use spoken playback, the applicable text is transmitted to a third-party AI provider to generate audio.
How your Entries are handled by our providers. Our AI providers process the content of your Entries as our service providers, solely to perform the features described above and not for their own independent purposes. Under the terms that govern our engagement of these providers, they do not use your Entries to train or improve their artificial-intelligence models.
Your consent. Before the content of your Entries is first transmitted to our AI providers, we request your consent within the App. You may decline that request. If you decline, the AI-enabled features will not function, but you may continue to capture and store your Entries. You may withdraw your consent at any time in Settings → AI features, which disables the AI-enabled features. Your existing Entries remain available to you.
AI output is not advice. AI output is generated by software, may be inaccurate or incomplete, and is provided for self-reflection and informational purposes only. It does not constitute medical, mental-health, psychological, therapeutic, diagnostic, legal, financial, or other professional advice. Refer to our Terms of Service for the complete disclaimers, including the emergency and crisis notice.
6. Service Providers and Sub-Processors
We engage service providers to perform functions on our behalf, and we disclose information to such providers solely to the extent necessary for them to perform those functions in connection with the Service. Such providers are subject to the terms of their respective agreements governing their handling of information. We engage service providers in the following categories:
| Category | Purpose | Information involved |
|---|---|---|
| App distribution, authentication & payments | Distribution of the App, account authentication, and processing of purchases and notifications | Account identifiers, purchase and subscription data |
| AI processing | Voice transcription, AI insights and reflections, and read-aloud | Voice recordings, transcripts, and text Entries |
| Cloud hosting & storage | Database, authentication, and secure file storage | Account data, Entries, and media |
| Subscription management | Administration of subscription and purchase status | Purchase and subscription status |
| Analytics & diagnostics | Product analytics and crash and error reporting (engaged as service providers and not for cross-context behavioral advertising) | Usage and diagnostic data |
We may also disclose information: (i) to comply with applicable law, legal process, or a lawful governmental request; (ii) to enforce our Terms of Service or other agreements, or to protect the rights, safety, property, or security of our users, the public, or us; (iii) at your direction or with your consent, including to any person to whom you grant access to designated portions of your Entries as described in our Terms of Service; and (iv) in connection with, or during negotiations of, any merger, acquisition, financing, reorganization, or sale of assets, in which event your information may be transferred as a business asset, and the recipient will either continue to honor this Policy or provide you with notice before your information becomes subject to a different privacy policy.
7. Data Retention
We retain information for as long as your account remains active or as otherwise necessary to provide the Service, and thereafter as set forth below:
- Account and Entries. Retained until you delete them or close your account. Entries that you delete are moved to “Recently Deleted,” from which they may be restored for thirty (30) days, after which they are permanently deleted.
- Backups. Purged on a rolling basis, generally within thirty (30) days.
- Purchase records. Retained as necessary for tax, accounting, and audit purposes (typically up to seven (7) years).
- Diagnostic and crash data. Typically retained for up to ninety (90) days.
- Usage and product-analytics data. Retained for a limited period consistent with our operational and analytical needs.
- Support communications. Retained as necessary to address your request and to maintain our records.
We may retain information for longer periods where required by applicable law or where reasonably necessary to establish, exercise, or defend legal claims. Aggregated or de-identified information that does not identify you may be retained indefinitely.
8. Your Choices and Rights
- Access and export. You may review your Entries within the App at any time and may export them to a folder you designate as Markdown files using the App’s iCloud Sync feature, or as a compressed archive using the App’s export feature.
- Correction and deletion. You may edit or delete your Entries within the App. You may delete your entire account, together with the associated content, from Settings → Delete Account; doing so removes your Entries and stored files, subject to the limited backup window described in Section 7.
- Shared access. If you grant another person access to designated portions of your Entries, you may modify or revoke that access at any time within the App. Revocation operates prospectively only and does not affect content that the recipient has already accessed, retained, or recorded.
- Notifications and device permissions. You may manage or revoke device-level permissions (including notifications and microphone access) at any time through your device settings.
- AI features. You may enable or disable the AI-enabled features, and thereby grant or withdraw your consent to AI processing, at any time in Settings → AI features. Disabling them halts any further transmission of your Entries to our AI providers, and you may continue to capture and store your Entries.
- Do Not Track. Certain web browsers transmit a “Do Not Track” (“DNT”) signal. The Service does not respond to DNT signals. We do not sell your personal information or share it for cross-context behavioral advertising, and accordingly there is no such tracking for you to disable.
To submit a request or an inquiry, please contact us at support@getclairapp.com. We may be required to verify your identity before responding, and we may decline a request where an exception applies under applicable law, in which case we will inform you of the basis for our decision. We will not discriminate against you for exercising any right described in this Policy.
9. Information for California Residents
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), affords you certain rights. The categories of personal information we collect are described in Section 2 (including identifiers, account information, your Entries and the audio and photographs contained therein, commercial and purchase information, internet and other electronic network-activity information, and inferences drawn to provide AI features). We collect this information from the sources, and use it for the purposes, described in this Policy; we disclose it only to the service providers described in Section 6; and we retain it for the periods described in Section 7.
- We do not “sell” your personal information, and we do not “share” it for cross-context behavioral advertising, as those terms are defined under the CCPA.
- Your voice recordings and reflective Entries may constitute sensitive personal information. We use sensitive personal information solely to provide the Service you have requested, and not for any purpose that would entitle you to direct us to limit its use under the CCPA.
- You have the right to know and access, to delete, and to correct your personal information, and the right not to receive discriminatory treatment for exercising these rights.
To exercise these rights, please contact us at support@getclairapp.com. We may be required to verify your identity before responding to your request. You may designate an authorized agent to submit a request on your behalf, in which case we may require written proof of the agent’s authority and verification of your own identity.
10. Privacy Rights of Residents of Other States
Certain other states afford their residents rights with respect to personal information that are comparable to those described in Section 9, which may include the rights to access, correct, and delete personal information, to obtain a copy of it, and to appeal the denial of a request. If you are a resident of such a state, you may exercise any right available to you under applicable law by contacting us at support@getclairapp.com, and we will honor that right to the extent applicable law requires. We do not sell personal information, share it for targeted advertising, or engage in profiling in furtherance of decisions that produce legal or similarly significant effects.
11. Security
We maintain administrative, technical, and organizational safeguards designed to protect the information we process. These measures include the encryption of data in transit using Transport Layer Security (TLS); the encryption of data at rest by the infrastructure providers that host the Service; access controls scoped so that each account may access only its own data; private file storage; and an optional on-device application lock secured by your device’s biometric authentication. Notwithstanding the foregoing, no method of transmission or storage is perfectly secure, and we do not and cannot guarantee absolute security. You use the Service at your own risk and are responsible for maintaining the security of your device and account credentials.
Home Screen widgets. So that the App’s optional Home Screen widgets can display your most recent reflection, the App keeps a copy of that reflection in a shared storage area on your device. Because a widget is rendered by the operating system outside the App, that copy is stored unencrypted and is not protected by the App’s optional application lock. If you enable the application lock, the App omits all reflection text from that copy, and the widgets display no content. The copy is removed when you sign out, delete your account, or delete the App.
12. Children’s Privacy
The Service is intended solely for adults eighteen (18) years of age and older. The Service is not directed to children; we do not knowingly collect personal information from any individual under the age of eighteen (18); and we do not knowingly transmit a minor’s information to our AI providers. If we become aware that we have collected personal information from an individual under the age of eighteen (18), we will delete such information. If you believe that a minor has provided us with information, please contact support@getclairapp.com.
13. Users Located Outside the United States
The Service is offered and intended solely for users located in the United States, and our servers and providers are located in the United States. We do not target or offer the Service to individuals located in the European Economic Area, the United Kingdom, or any other jurisdiction outside the United States, and you should not access or use the Service from outside the United States. If you access the Service from outside the United States, you do so on your own initiative and are solely responsible for compliance with applicable local law.
14. Amendments to this Policy
We may amend this Policy from time to time. Any amendment becomes effective upon the posting of the amended Policy, as indicated by the “Last updated” date set forth above. If we make a material change, we will provide notice by reasonable means, which may include notice within the App or by email. Your continued use of the Service following the effective date of an amendment constitutes your acceptance of the amended Policy. We encourage you to review this Policy periodically.
